Rarely used option: The H-2B Visa

While, as mentioned in previous editions, it is becoming more and more complicated to obtain the H-1B Visa (work visa for up to 6 years), since there are more applicants than visas every year, another visa option remains widely unused. With the H-2B Visa, applicants who are needed by US employers for a short time may enter the country. The cap on the category are 66,000 visas, however, only between 2000 to 3000 people a year apply for one.

That is mostly caused by the relatively strict requirements for the short-term nature of the job. The employer not only has to meet the usual H-1B requirements (proof that no US worker could be found for the position and application for a Labor Certification to the Department of Labor), but he also has to prove that the job is of a short-term nature (e.g. due to a seasonal lack of workers, an unusual event, a major contract or something similar).

The visa is issued for a maximum period of one year and can be extended to a maximum length of 3 years. However, extension applications are usually checked meticulously and are often rejected.

Still, the H-2B visa is a good option, since, opposed to the H-1B visa, there are hardly any waiting times.
