H1B Visa - Fiscal Year 2010 Reaching its Limit

The H1B cap for fiscal year (FY) 2010 is close to reaching its limit. There are still some cap numbers left because of unused numbers, but there are many people who will be looking to FY11 for filing their H1B petitions.

The government's fiscal year begins annually on October 1st. Thus, FY11 starts on October 1st, 2010.
The earliest day for requesting the H1B cases therefore is October 1st, 2010 (FY 11).

If you are thinking about requesting a H1B visa, you can apply for it up to six months prior to the beginning of your employment start date. But keep in mind that H1B petitions FY 11 cannot be filed for before April 1st, 2010. An application is only possible after that day.

These filings can continue until the cap (65.000) is reached. It is impossible to know when this number will be reached. The filing for FY10 started on April 1st, 2009 and still continues until now. Things were far different in FY2008 and FY2009, when the cap was exceeded in the initial filing period minimum of the first few days.
