H-3 Visa „Trainees“ » What qualifications does the foreign beneficiary need?
Not only the training program, but also the foreign beneficiary has to be eligible for the H-3 visa category:
- The training offered is needed to advance the beneficiary’s career, and the beneficiary will benefit in pursuing a career in his or her own home country (and NOT the US).
- The beneficiary will not receive any kind of medical training.
- The beneficiary will not work in production (unless the program specifically requires it).
- The beneficiary will not be placed in a position in which US citizens are regularly employed.
- The training or a training equivalent to it is not available in the trainee’s home country (this needs to be demonstrated).
Please note: Sometimes US authorities refuse the visa exactly because of this. Why? They argue that the very lack of training programs in the beneficiary’s home country increases the likelihood that he or she will want to stay and work in the US after completing the training.
