What requirements does the job offer from the US have to meet?

The H-2B category is a work permit for almost any kind of employment, the only exception being the agricultural field, which is not included.

The time of employment must be limited or seasonal for a maximum of one year.

However, the one requirement that often proves to be the greatest obstacle in the H-2B application process is the US employer’s obligation to search for US workers qualified and willing to do the work. In other words, the employer has to prove that no US worker was available before the job can be offered to a foreign worker. Only after that will the Department of Labor issue a labor certification.
