As we have already mentioned in our last newsletter, things have changed a little even for visa holders who want to enter the US or fly inland as a consequence of the terrorist attacks on September 11. Of course the Immigration Service, as the guard of the most sensitive part of the country, had to introduce some measures that we would like to inform you about today.
IMPORTANT: Always have all your visa documents with you.
We have received some reports saying that immigrants and non-immigrants all around the country are constantly being asked for their documents, especially at the airports, of course. Article 264(e) of the US immigration law states anyway that all persons who are not US citizens are obligated to always have all registration documents of the US Immigration Service. However, especially for inland flights, this was seldom enforced before September 11.
You should have the following documents with you:
-For all those who are in the US as non-immigrants: your I-94 Arrival-Departure Record, the one you have to fill out on the plane shortly before landing. This especially applies to all those who are in the US on the Visa Waiver Program.
-For all H-1B, E and L visa holders: As far as possible the copies of your "Notice of Action," as well as (if possible) excerpts from your original application (you can get this from your US law firm or company)
-For airline personnel: Your I-95 Landing Permit, or your I-184 Alien Crewman Landing Permit, and your Identification Card
-For green card holders (!): Passport with valid admission stamp, I-551 Alien Registration Card (green card), or temporary I-688A or I-688B Employment Authorization Document.
In case you have applied for an adjustment or change of status, please carry with you a cop of your I-797 (Notice of Action, filing receipt), it is also advisable to have a copy of your original application to the INS with you.
Persons with a non-immigration visa who have applied to have their status changed to a green card, will be regarded as being in the country legally. In this case, it is advisable to have with you the filing receipt of your application (I-797, see above), a copy of your interview confirmation, copies of your advance parole, the application or your EAD card (Employment Authorization Card, in case you have one.
