SURPRISE: NEW H-1B WORK VISAS ALSO FOR PERSONS WITH NO MASTER'S DEGREE As we have reported in one of our previous editions, the H-1B cap for the current fiscal year (until the end of September 2005) has already been met. As we have also reported already, US Congress had decided in the meantime to grant a further 20,000 visas in addition to the regular quota. The requirement for those is that applicants have a master's or higher degree from a US university.
To everyone's surprise, US Citizenship and Immigration Services overruled this regulation in a press release last week.
According to this, everyone who qualifies for a regular H-1B visa (bachelor's degree or equivalent work experience of at least 12 years) may also apply for the visas in this special quota. However, the text in the release conflicts with the valid immigration laws. USCIS points to the fact that the regulations become effective as soon as the implementation rule is published in the Federal Register.
