How does the application process work?

In contrast to most other immigration applications, the EB-5 application can only be submitted by the investor himself.

The petition (I-526) has to be filed at the appropriate Service Center of US Citizenship and Immigration Services (USCIS) in the U.S. In addition to the fees, extensive additional documentation has to be added to the application, especially evidence that the employee meets the respective requirements. Please note that green card applications are very complex processes.

IMPORTANT: For the EB-5 visa, Premium Processing is currently not available.
Find information about the USCIS processing times on this website: https://egov.uscis.gov/cris/processTimesDisplay.do.
Please also note the information in the Visa Bulletin stating current availability of immigration visas and thus also about respective waiting times. In the EB-5 category, visas are usually always available.

After approval by USCIS, the applicant will be issued the green card in the so-called Consular Processing. This process as well should not be underestimated.
Furthermore, the applicant has the option of applying for "adjustment of status" in the U.S. (e.g. if he or she already has a valid non-immigrant status).
