Is a Labor Certification required?

Same as for the other "Priority Worker" categories, no Labor Certification is required for the EB-1B application. This means that the US employer does not need to prove that no US worker was available for the job.

However, the US employer, even if this employer is a large US university, has to provide evidence indicating that he is able to pay the future employee's salary. In case the institution has more than 100 employees, a simple confirmation by a worker form the finance department will be enough.
