YOUR QUESTION:

Is it true that due to the poor job market in the U.S. it is easier to apply for an E-2? Could you please let me know how long the whole process takes?

 

OUR ANSWER:

Actually we can not say that due to the economy situation in the U.S. it became easier to apply for an E-2 Visa (Treaty Investor). The legal regulations have not changed and the entrance requirements are still the same. Basically the applications must be very well prepared.

It is really hard to estimate how long the process will take, it is extremely variable.

The collection of documents is what takes the longest to complete, usually you have to present a very extensive file. The request to establish/buy/acquire a business in the U.S. might take several weeks to be overviewed and granted, the simple processing time at the consulate are about 3-4 weeks. After submission of the file you will receive an invitation to a consular interview, on this day the consular officer will decide whether the Visa should be granted or not, then after a week you will receive your passport via regular mail.

 

 

 

YOUR QUESTION:

I am about to sign an employment contract in the USA, the American employer will apply for me an O-1 Visa. My girlfriend will join me and we are planning to move in February, until then we are probably married. That is to say my friend/wife would get an O-3 Visa. What would happen in case of a divorce? Could she stay in the U.S.? Or by when she would have to return?

 

OUR ANSWER:

Your partner can only obtain a so called derivative status and thus an O-3 Visa, if you would marry her before but under this visa category she is not allowed to work in the U.S., she may only accompany you. If you divorce she would have to leave the country or change her visa category. The same would apply in case you would give up your O-3 status, in other words your wife status or her permission to stay in the U.S. is connected, coupled with yours.

 

 

 

YOUR QUESTION:

I am a Brazilian citizen, married and I live and work here in Germany.

I would like together with my wife to go on vacation in the U.S., do I need a Visa for this purpose and if so, do I have to enter the application in Brazil?

 

OUR ANSWER:

Unfortunately because of your nationality you are not allowed to enter the USA under the Visa Waiver Program, which allows tourists to stay up to 90 days without having to apply for a Visa. As a Brazilian citizen you have to apply for a B-2 Tourist Visa in person at a U.S. consulate in the country where you are currently living and working, it does not have to be the country of your nationality. As you described you are married, living and working in Germany, so you could apply in one of the following Consulates (where you also will be scheduled for an appointment): Frankfurt/Main, Berlin or Munich.

In your case it is also important to attach to the usual standard documents your permit of residence in Germany, the employment papers you might have, financial records and a copy of your certificate of marriage.
