What are the requirements for the employee?

Strict requirements do not only apply to the company, but also to the employee who is going to receive the green card.

The following criteria have to be met:

  • During the three years preceding the petition, the beneficiary must have worked for an affiliate, parent or subsidiary outside the US of the company within the U.S.
    PLEASE NOTE: Quite frequently, managers and executives are already working in the U.S. - on some kind of work visa - at the time of the petition. In case the employer is the same who is going to petition for the immigration visa, the three-year period starts immediately before the employee entered the US on the work visa.
  • Executive or managerial positions with the company outside the U.S. An executive usually makes important contributions by setting company objectives or has an important function in the management of the company. An executive usually has unlimited decision-making powers and is only subordinate to the board of directors or board of management. A manager is leading the company, a department or other administrative unit. He leads the day-to-day operations of a certain department and also oversees (mostly high-ranking, highly qualified) employees.
  • Managerial or executive position in the U.S. company.
