What requirements does the job offer from the US have to meet?
One of the lesser observed, yet crucial cornerstones of the H-1B system is, that not only the foreign applicant, but also the US company with its job offer has to qualify for the H-1B visa category. Not every job offer meets the H-1B standards. Since a bachelor’s degree is the minimum requirement for this visa, it has to be the minimum requirement for the position as well. This means that the tasks associated with the offered position have to require the knowledge and skills acquired with a university or college degree.
The offered position must therefore
- match the workers high qualification- require special knowledge
- include a certain amount of responsibility
- pay 100% of the prevailing wage
