What type of visa do accompanying family members get?

Spouses and unmarried children under the age of 21 will receive the L-2 visa. Other than the H visa, which excludes a work permit, the L-2 visa allows the accompanying spouse to apply for an Employment Authorization Document (EAD) in the U.S.

The work permit will be issued for two years, and can be extended for two more years depending on the situation on the local labor market. Maximum validity corresponds with that of the transferee’s L-1 visa.

Children may attend school or university.

 

IMPORTANT: unmarried or same-sex partners do not receive a related status, the latter even if they are married under foreign law or U.S. state law. They will have to apply for their own (work) visa.
