English » U.S. Visa Services » Work Permit (Nonimmigrant Visa) » O-1 Visa “Extraordinary Ability” » What type of visa do accompanying family members get?
Spouses and unmarried children under the age of 21 can apply for the O-3 visa. Other than derivative visas in the L-1 or E-1/E-2 category, the O-3 visa does not allow the accompanying spouse to apply for a work permit.
Children may, of course, attend high school or college/university.
IMPORTANT: unmarried or same-sex partners do not receive a related status, the latter even if they are married under foreign law or U.S. state law. They will have to apply for their own (work) visa.
